Family Medical Leave Act (FMLA) Administration

The Family Medical Leave Act of 1993 states that covered employers m ust grant family - and temporary medical - leave to employees under certain specific circumstances. Eligible employees may take up to a total of 12 work-weeks of unpaid leave during a given 12-month period for one (or more) of the reasons listed below:

  • the birth and care of the newborn child of the employee
  • placement with the employee of a son or daughter for adoption or foster care
  • to care for an immediate family member (spouse, child, or parent) with a serious health condition
  • to take medical leave when the employee is unable to work because of a serious health condition

FMLA contains notification requirements. Questions often arise about leave taken intermittently or on a reduced leave schedule. There are numerous questions involving FMLA and COBRA. Employers have questions regarding eligibility.
