Compliance Webinar — Handling ERISA Plan Assets: MLR Rebates, Premium Credits, and FSA Forfeitures

Employers that sponsor health and welfare plans have a fiduciary obligation to ensure that they properly handle plan assets on behalf of participants. An employer that receives a premium credit, medical loss ratio (MLR) rebate, or flexible spending account (FSA) forfeitures must determine whether those amounts constitute plan assets. Once in receipt of plan assets, an employer’s decisions on applying or using the rebate or credit will be subject to ERISA’s fiduciary duty rules.
